Public Offer (Agreement) for Temporary Accommodation Services

Please read the text of this Public Offer (Agreement) for the provision of services. If you do not agree with or do not understand any of the provisions of this Public Offer (Agreement), we recommend contacting the Hotel staff for further clarifications.
The services are provided on the premises of LLC “SUCCESSFUL HOTEL,” located at: Lviv, Shevska St., 4 (hereinafter – the Hotel), and include: accommodation of individuals by providing a hotel room (space) for temporary stay. By accepting the offered Services at the Hotel, you are deemed to fully and unconditionally agree with all the terms of this Public Offer (Agreement) for the provision of services and the Hotel’s rules of stay, and accept them in full (including agreeing to fulfill all obligations imposed on you by this Public Offer (Agreement) for the provision of services and the Hotel rules of stay, and you understand all their provisions). The Public Offer (Agreement) for the provision of services and the rules of stay in the Hotel define the rights, duties, and responsibilities of the Hotel and the Consumer, operate simultaneously, and complement each other.
1. General Provisions
1.1. This Public Offer sets out the terms of the Agreement in accordance with Art. 641 of the Civil Code of Ukraine and is an official Public Offer addressed to other persons (hereinafter – the “User” or “Users,” or “Client,” or “Consumer,” or “Consumers,” or “Guest,” or “Guests”) for entering into an Agreement for the provision of accommodation services (providing a room/space for temporary stay) under the conditions set forth below.
1.2. Hereinafter in the text of the Public Offer (Agreement), the Hotel and the Consumer are collectively referred to as the “Parties,” and each individually – as a “Party.”
1.3. Each Party guarantees to the other Party that it has the necessary legal capacity, rights, and authority sufficient for entering into and performing the Agreement in accordance with its terms.
1.4. The text of the Public Offer (Agreement) is always posted on the Hotel’s information stand and official website marketsquarelviv.com.
1.5. The Consumer agrees to notify third parties of information arising in connection with the execution of this Public Offer (Agreement) and the provision of services by the Hotel.
2. Offer (Public Offer) / Subject of the Agreement
2.1. The subject of the Public Offer / Agreement is the provision by the Hotel to the Consumer of paid accommodation services by providing a room (space) for temporary stay at the Hotel’s location, in a specially equipped residential unit (room) in accordance with the booking request.
2.2. The Agreement is deemed concluded and comes into force from the moment the Consumer performs any action specified in Clause 3.4 of the Agreement, which constitutes full and unconditional acceptance of all terms of the Agreement without any exceptions or limitations in accordance with Art. 642 of the Civil Code of Ukraine. An Agreement for the provision of accommodation services concluded by the Consumer through acceptance of the Public Offer has legal force in accordance with Art. 642 of the Civil Code of Ukraine and is equivalent to a written Agreement signed by the Parties, and the User is deemed to have read and agreed to the terms of this Public Offer (Agreement).
3. Procedure for Concluding the Agreement
3.1. The Agreement is concluded between the Hotel and the Consumer as a contract of adhesion (Art. 634 of the Civil Code of Ukraine).
3.2. Acceptance of the Public Offer is the Consumer’s performance of any of the actions specified in Clause 3.4 of the Agreement.
3.3. Acceptance of the Public Offer constitutes full, unconditional, and unreserved acceptance by the Consumer of all terms of the Agreement without any exceptions or limitations and is equivalent, according to part 2 of Art. 642 of the Civil Code of Ukraine, to the conclusion of a bilateral written Agreement under the terms set forth in this Public Offer. By entering into the Agreement, the Consumer:
– has fully read and agrees with the rules of stay in the Hotel;
– recognizes the unconditional suitability of the Hotel premises for the purposes described in this Agreement;
– accepts all terms of this Agreement without comments or objections.
3.4. The Consumer, in accordance with Art. 642 of the Civil Code of Ukraine, confirms the fact of acceptance of the Public Offer upon performing any of the following actions:
– paying for temporary accommodation services through the reception or by bank transfer based on issued invoices, or by bank card;
– directly using the Hotel services (checking in);
– completing the registration form / receipt / questionnaire at the reception.
3.5. The Consumer undertakes to provide accurate personal data and information when registering to receive Hotel services.
3.6. The term of acceptance of this Public Offer is unlimited.
4. Rules for Using Hotel Property
4.1. The Hotel provides Guests with furnished rooms equipped with household appliances (TV, hairdryer, refrigerator, etc.), plumbing, and other equipment. Hotel rooms and common areas are insulated, have modern finishes, engineering systems, and equipment that meet all requirements at the time of commissioning.
4.2. Guests must handle Hotel property with care, use equipment as intended, and comply with fire safety requirements. In case of damage to property, technical malfunctions, or emergencies (flooding, fire, broken glass, etc.), the Hotel Administration must be notified immediately.
4.3. After checking into the room, within one hour, the Guest may report to the Administrator any deficiencies in the furnishings and room equipment. If no report is made, and the Administration identifies losses or damage upon check-out, the Guest shall compensate for material damages.
4.4. Upon check-in, the Guest receives a key (plastic card), which must be returned on the day of departure. A fine is charged for lost keys.
4.5. In case of loss or damage to the Hotel property due to the User’s fault (including towels, bathrobes, dishes, furniture, and other inventory), the Guest must compensate within 2 calendar days, but no later than the check-out date, the amount determined according to prices on information stands, consumer corners, menus, price lists, or, if absent, by a commission of the Administrator, reception staff, and any other Hotel employee at market value.
5. Internal Rules of Stay in the Hotel
5.1. The Hotel operates 24/7. Check-out time is 12:00, check-in time – 14:00. Rooms are provided upon presentation of a passport or other identification document and completion of the Guest registration form in the prescribed format. After entering into the Accommodation Agreement (completing the form), the Guest receives the key to the room assigned for their stay from the Administrator.
5.2. From 22:00 to 8:00, silence must be maintained within the Hotel premises. During this time, it is forbidden to play audio systems or televisions at high volume in the rooms.
5.3. Visitors may come to Guests between 7:00 and 23:00. The stay of visitors requires consent from the room’s registered Guest, and the Administrator keeps a record of all Hotel Guests. The registered Guest is responsible for their visitors. If necessary, the Administrator or security staff may check visitor identification.
5.4. Smoking is prohibited in the rooms and other Hotel premises. A fine is imposed for violations. In case of repeated violations, the Hotel Administration may evict the Guest unilaterally without refunding the cost of services provided.
5.5. If a Guest wishes not to be disturbed, they may hang a “Do Not Disturb” sign provided with the room. The reverse side of the sign reads “Please Clean.” The Guest may use this sign if they consider the room insufficiently cleaned.
5.6. Storing weapons, explosives, narcotics, and psychotropic substances in hotel rooms is prohibited. Animals may only stay in the Hotel with prior approval from the Hotel Administration.
5.7. Compliance with the Hotel’s internal rules is monitored by the Administrator, who provides clarifications on the rules, accepts complaints from Guests regarding staff or other Guests violating the established order.
6. Energy Conservation
6.1. It is prohibited to use power strips, extension cords, or high-power electrical appliances in rooms, except those included in the standard room equipment or provided for Hotel staff use.
6.2. Water taps (hot and cold) must not be left running unnecessarily. Taps must be turned off when leaving the room.
6.3. In the absence of centralized electricity, power is supplied by the emergency generator. Electricity usage from the generator is limited (it is recommended to turn off all electrical appliances, including TVs). Excessive use may lead to power outages throughout the Hotel.
7. Video Surveillance
7.1. The Hotel territory, entrances, internal stairs, and corridors are monitored by video cameras. All information is recorded, stored on digital media, and kept for security purposes, ensuring the safety of Guests, their property, and the Hotel’s property. By signing the registration form, the Guest acknowledges and does not object to video surveillance in the Hotel premises (excluding rooms and toilets).
8. Arrival and Vehicle Parking
8.1. Parking is allowed in designated areas subject to availability. Parking may be time-limited.
9. Services Provided by the Hotel
9.1. The Hotel provides basic services included in the room rate, and additional services for a separate fee.
9.2. Basic services include: room provision, cleaning, breakfast, emergency call, first aid, wake-up service at the requested time, and mail delivery to the room.
9.3. The Hotel accepts Guests for 24-hour accommodation. Rooms are provided for a specified number of occupants. If additional guests require accommodation and the room allows it, they are charged extra. Children under 18 can only be accommodated with adults (parents or relatives).
9.4. Daily cleaning includes dusting, garbage removal, washing glasses, and cleaning bathrooms.
9.5. Full cleaning is conducted after each Guest check-out.
9.6. Towels and bed linen are replaced no more than once every three days. Extra replacement is possible upon Guest request.
10. Room Booking
10.1. Room booking:
  • The Hotel Administration may enter into agreements for room reservations. If rooms are available, bookings are accepted from legal entities and individuals.
  • The Hotel may conclude a booking agreement with the Customer for non-cash payment and at specified room rates, signed by both parties. The agreement is valid only upon the Hotel’s written confirmation of the booking request.
  • Booking requests may be sent via mail, phone, or other communication methods (including email or fax) that reliably identify the requester.
  • Booking requests for individual tourists, citizens, and groups must be submitted within the timeframe set by the Hotel Administration under the concluded Agreement.
  • For individual bookings paid by cash or credit card, a separate booking agreement is not required. The confirmation of the booking, including rate and check-in/check-out dates, serves as proof.
  • Bookings are considered “non-guaranteed” without prepayment. To make a booking “guaranteed,” the Guest must prepay 100% via credit card, bank transfer, or authorize pre-authorization on their credit card. Prepayment or pre-authorization can be made via the website or by prior arrangement.
  • Six days before arrival, the Guest must guarantee their booking via Hotel pre-authorization of the Customer’s credit card.
  • Non-guaranteed bookings are valid until 18:00 on the arrival date and may be canceled by the Hotel without notice.
  • By confirming a booking, the Guest agrees to the above conditions and the cancellation rules, including the no-show policy.
10.2. Booking Cancellation:
  • Cancellations must be sent in writing to res@marketsquarelviv.com or by phone +380322462344, +380322462345. Free cancellation is available up to 24 hours before arrival (except special non-refundable rates).
  • Late cancellations incur 100% payment of the confirmed booking, including additional services.
  • No-show after 24 hours before 14:00 on the arrival date results in forfeiture of prepayment (100% of the booking), considered a penalty payable to the Hotel.
  • All prices are in UAH; payment is required before or upon check-in via cash, card, bank transfer, or invoice. Visa, Mastercard, and American Express are accepted.
  • The room rate excludes a tourist tax of 40.00 UAH / night / person (VAT excluded).
10.3. Exemption from tourist tax applies to:
  • Business trip orders (scan copies must be provided);
  • Minors and persons with disabilities, with valid documents, including one accompanying person for disabled persons;
  • War veterans or participants in military operations (including ATO);
  • Participants in the Chernobyl disaster cleanup;
  • Guests under 18 years of age.
11. Rights and Obligations of Guests
11.1. Guests staying at the Hotel are prohibited from:
  • Bringing in or storing substances, materials, and items that are dangerous to life, health, or property.
  • Leaving unauthorized persons in the room or giving them room keys.
  • Smoking tobacco, electronic cigarettes, or hookahs anywhere in the Hotel (rooms, corridors, lobby, restaurant, etc.). Smoking is only allowed in designated areas (information available from the Administrator). A fine of UAH 3,000 applies for each violation.
  • Removing tableware, food, or beverages from the restaurant without prior consent from the Restaurant Administration.
  • Using electrical appliances not included in the room equipment or misusing Hotel equipment.
  • Disturbing other Guests’ peace between 22:00 and 8:00.
  • Bringing or storing unregistered firearms, pneumatic, or other types of weapons.
  • Staying with animals over 5 kg, except guide dogs, without prior approval.
  • Using or storing high-power electrical appliances not included in the room equipment, such as boilers or pressure cookers.
  • Bringing flammable, explosive, or other hazardous materials.
  • Bringing items that emit unpleasant odors.
  • Bringing excessively large items or excessive quantities of items.
  • Bringing or storing narcotic substances or other items prohibited by Ukrainian law.
11.2. Guests’ Rights and Obligations:
  • Guests may invite visitors to their room from 07:00 to 23:00, up to 3 persons simultaneously, excluding registered Guests of the room. Visitors staying past 23:00 may require an additional payment for the difference between single and double occupancy if applicable.
  • Guests are liable for any damage to the Hotel property caused by themselves or their visitors. The Hotel Administration determines the damage amount. Guests must fully compensate for damages within five banking days based on the Damage Act.
  • In case of disputes over damage compensation requiring additional review, the deposit will be retained until the procedure is completed, including preparation of the Damage Act.
11.3. Rules for Staying with Animals:
  • Animals under 5 kg or guide dogs are allowed only with prior approval from the Hotel Administration.
  • Guests with animals must stay in designated rooms assigned by the Hotel Administration.
  • At check-in, Guests must provide credit card details for deposit blocking or pay a cash deposit of UAH 3,000 as a guarantee for potential damages caused by the animal. If no damages occur, the deposit is returned within 14 days after check-out, depending on the bank.
  • A fee of UAH 500 / night applies for staying with an animal under 5 kg.
  • Animals may not be left alone in the room.
  • Guests must provide all necessary hygiene items for their animals.
12. Force Majeure
12.1. Circumstances of force majeure are defined in Article 141 of the Law on the Chamber of Commerce and Industry.
